Terms of Use

Please read these Terms of Use carefully before downloading or using BikeControl (the "Application"). By installing or using the Application, you agree to be bound by these terms. If you do not agree to these terms, do not install or use the Application.

1. Acceptance of Terms

These Terms of Use constitute a legally binding agreement between you ("User") and OpenBikeControl UG (haftungsbeschränkt) ("Company", "we", "us", or "our") governing your use of the BikeControl mobile and desktop application, including any updates or upgrades provided by the Company.

2. License Grant

Subject to these Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the Application on devices you own or control.
  • Use the Application for your personal, non-commercial purposes.
  • Access features and functionality as made available through the Application.
  • Use premium features if you have purchased the relevant subscription or license.

3. Restrictions

You agree not to, and will not permit others to:

  • Copy, modify, or create derivative works of the Application or any part thereof.
  • Reverse engineer, disassemble, decompile, decode, or otherwise attempt to derive the source code of the Application.
  • Remove or alter any proprietary notices, labels, or marks on the Application.
  • Use the Application for any unlawful purpose or in violation of any applicable laws or regulations.
  • Sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the Application.

4. Intellectual Property

The Application and all content, features, and functionality thereof — including but not limited to all information, software, text, graphics, logos, icons, and images — are the exclusive property of OpenBikeControl UG (haftungsbeschränkt) and are protected by applicable intellectual property laws. All rights not expressly granted to you are reserved.

5. Third-Party Services and Hardware

BikeControl is designed to work with third-party hardware devices (such as Zwift Click, Shimano Di2, and others) and training applications (such as Zwift, MyWhoosh, and Rouvy). The Company is not affiliated with, endorsed by, or sponsored by any of these third-party companies. Use of third-party services is subject to their respective terms and conditions. The Company is not responsible for the availability or functionality of any third-party service or hardware.

6. Disclaimer of Warranties

The Application is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. The Company does not warrant that the Application will be error-free, uninterrupted, or free of viruses or other harmful components. Your use of the Application is at your sole risk.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of data, loss of profits, or business interruption, arising out of or in any way connected with the use of or inability to use the Application, even if the Company has been advised of the possibility of such damages.

8. Termination

This license is effective until terminated. It will terminate automatically if you fail to comply with any of these Terms. Upon termination, you must cease all use of the Application and delete all copies from your devices. The Company may also terminate or suspend your access to the Application at any time, with or without cause, without notice.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Germany.
